Franchising is the use of a profit-proven business model of another business entity. It`s a distribution method, where the product or service owner (franchisor), gives the possibility and sells the right to the franchisee to act in the market under his recognizable name/brand and distribute its products or services; uses its name and brand, "know how", method and system of business, advantages through experience in the market, receives training and profitability guidelines.

In September, the Serbian Franchise Association was founded, which cooperates closely with the Serbian Chamber of Commerce. Marica Vidanović from the SCC Franchising Center, who is also a member of the Board of Directors of the Serbian Franchise Association, explained the value of franchising, who this business model is for, what the prospects are and what the future of this model is in our country.

eKapija: Franchising is mentioned as a business opportunity for both providers and recipients. What does it bring to franchisors and what conditions must be met by someone to be a franchisor? Who can be a franchisee?

- The percentage of successfully implemented franchises, whether someone buys a franchise brand or wants to create a franchise from his existing business format, is precisely for the reason that it uses a proven, systematized, profit-oriented business model of another legal entity. The franchise relationship is based on the transfer of specific knowledge, "know-how" and business secrets, which the franchise owner transfers to the franchisee through training and thus ensures an easier path to joint business success.

Practice has shown that for entry into entrepreneurship, buying a franchise is a safer way to start your own business, because entering into entrepreneurship through a franchise offers the transfer of an already tested, profitable business system, knowledge, experience and skills. Franchise business plays a significant role in every country, because it facilitates the development of entrepreneurship, accelerates it and makes it safer.

The franchisor can be any entrepreneur or legal entity, who is the owner of a trademark and visual identity recognizable on the market, but who performs work that brings profit in the long term, a business that is built around a unique or unusual concept or at least possesses a competitive edge in the market, a business with the possibility of wide geographical application, a business that is easy to manage, a business whose operating costs are not extremely high, and a business that is easy to duplicate (copy). It is expected that the future franchisor will implement its concept, ie. successful "know-how", and it is certainly also obliged to "translate" it into written standards, in order to be able to transfer his experience to the franchisee. This can sometimes be a great stepping stone for companies entering into franchising, because undoubtedly with this procedure in a large number of cases, they improve their own system of work.

The franchisee is a completely independent legal entity, which, by purchasing a franchise, defines the way it will operate on the market. The franchisee must certainly have certain funds at his disposal, who wants to work within the system and according to set rules. By accessing the network, he acquires the right to use all the elements that are the subject of the offer: the method, system or know-how, products, brand and image, assistance before, during and after opening, etc.

"Follow the rules" is the basic premise of franchising and very important for the franchisee`s success. Franchisees buy a franchise with the belief that they will achieve success and profitability operating in accordance with operational rules.
Franchising does not suit everyone equally. Some prefer complete independence to succeed on their own, while others prefer working conditions in large companies. For the partnership between the franchisor and the franchisee to be successful, it is not enough that the franchisee likes the business model, but also the culture, values and goals that follow a business model. And, it also applies in the opposite direction.

Those who do a thorough analysis will get a simple answer: franchising offers the opportunity to earn more money, but to start an independent business themselves, and to understand the potential of a higher return on investment over a longer period - despite paying an initial fee and a percentage of the total turnover.

eKapija: Can a franchise guarantee lower risk and higher success than starting your own business?

- Buying a franchise is very profitable, because by buying franchising you are initially buying an already tried and tested business system, which provides greater security at the start of business, lower risk for survival on the market, rapid business expansion, competitive advantage, training and coaching, support in crisis times, elaborate marketing, more favorable conditions for the procurement of goods and furnishing of premises according to already established rules, defined financial plans.

For the franchisor, the main benefit is the opportunity to use the franchisee`s money to expand the brand faster than they could do with their own resources or through loans and independent investors. The initial fee for joining the system and the monthly fees they receive subsequently allow the franchisor to develop their brand without external control and pressure which they might have from potential investors or creditors. The fees are used to cover operational costs at the head office, for franchisee training and support, marketing and brand advertising, improvement of the quality of products and services and positioning of the brand in the market.

The advantages for the franchisee are:

- a large number of choices;
- lack of knowledge and experience can be compensated by training;
- a higher probability of success than in independent entrepreneurship:
- the recipient is an independent businessman;
- shorter time needed to start a business:
- initial training and ongoing support;
- assistance in finding the optimal locations;
- the sales power of a well-known brand and quality goods or services;
- the possibility of using a functional business model;
- lower expenses through group procurement, national and regional promotional and marketing campaigns;
- contacts with new customers through the corporate customer service or website, contacts with other franchisees who can provide moral and counseling support and exchange of experiences through internal communication channels or annual conferences and assistance in business financing.

eKapija: How many franchise brands operate in Serbia? Are there more domestic or foreign? Is there a particular sector that stands out in terms of the number of franchises? Where do you see the greatest perspective?

- The market of Serbia is largely open for business under the auspices of franchising, because with its potential and the diversified demand of the local population it represents the most significant market of all countries of the former Yugoslavia. However, awareness of the advantages and possibilities of franchising in Serbia is still not at the level it should be in business circles and lacks knowledge about franchise business, unlike our neighbors. We have certainly noticed that there has been an increased interest of Serbian companies which recognized franchising as a successful modality of sales network expansion.

According to the last unofficial surveys by the SCC, in 2023, a total of 220 franchise concepts operated in Serbia, where the greater part, as much as 80%, is in favor of foreign brands, that occupied more than 3,550 retail capacities and employed more than 23,500 people.

In Serbia, franchising as a business concept was most prevalent in the service sector (hospitality - fast food restaurants, traditional restaurants, then real estate sales, car service, business services, maintenance, hotel management, tourism, etc.). A big "boom" has been noticed in the area of children`s education, in terms of mental arithmetic,
system of using children`s logic, development of IT skills, etc.

On the other hand, regarding the development of franchising in Serbia, there are many factors that need to be improved or introduced:

- no laws regulate franchising;
- lack of professional staff for franchise operations / legal and economic issues;
- absence of support for development from institutions and the state;
- both startup and entrepreneurship growth rely mostly on own finances;
- lack of banks interested in franchise business, i.e. granting special franchise loans;
- lack of support from institutions and development agencies;
- lack of strategic thinking among small entrepreneurs, fear of competition;
- entrepreneurs are reluctant to accept this way of growth for fear of intellectual property theft;
- absence of Franchising Law and Disclosure LAW - lack of protection of the franchisee and franchisor.

eKapija: SCC organized a series of seminars dedicated to franchising. What was the level of interest, what interested those who responded the most?

- The interest of businessmen was great, which we expected. In addition to Belgrade, we visited Kruševac and Novi Sad, to begin with, because the held series of seminars was just an introduction to what SFA plans in the coming period. There was a much larger number of those who were interested in creating a franchise from their existing business, but they don`t know how, what is needed, how long they need, and certainly what we emphasize at every performance is that great attention must be paid to the Franchising Agreement, which is very complex, and has to be done by someone with a lot of experience.

Besides the Agreement, written procedures and manuals are indispensable and represent the transfer of "golden know-how", because that`s exactly what the recipient pays when they enter the franchise. Certainly, the Serbian Franchise Association will continue to provide consultations to all interested parties, precisely in order not to make mistakes in the beginning that can "cost" a lot to both parties.

eKapija: The Serbian Franchise Association was founded in September and in October, a cooperation agreement was signed with SCC. What are the goals defined and what activities will be implemented?

- In all countries in the region, at the level of the EU and the rest of the world, national franchise associations are precisely those, which, through its promotion role, affirms the franchise sector, as well as its reputation, they are lobbying for a franchise business model. The main objectives of the national franchise organization should be to represent the economic, social and political interests of the franchise industry.

In the discussions that the Serbian Chamber of Commerce conducted with the European Franchise Federation (EFF) and the World Franchise Council, as two world-renowned institutions that gather all national associations and globally recognized experts in the field, with their recommendation, and SCC also recognized that it was an excellent moment to establish a new National Franchise Association in Serbia.

SCC is recognized as the national carrier and pivot of franchising in Serbia and with its activities it has contributed in the previous period to the continuation of activities on the development of this sector, but, besides the PKS, this part of the work must be transferred to the future Association.
By strengthening the national franchise organization and its larger presence on the market, the gathering of all the factors involved in franchise business, it will affect the greater popularization of a quality, proven and certified franchise business model. It is precisely for this reason that the Memorandum on Cooperation was published, for the purpose of association and synergy of future activities at the national level. SFA will direct its activities to the promotion of its members, ie. of national concepts abroad, as the membership in the European Franchise Association "opens the door" in many markets.

The Serbian Franchise Association is a non-governmental, non-partisan and non-profit association of citizens founded on the initiative of the Serbian Franchise Community as a response to the need to introduce the concept of franchise business to businessmen in Serbia and create positive conditions for its further development and application. The key role of the SFA is to emphasize the role of franchise in an open market economy, protection of franchise business through the presentation of the European Code of Ethics for Franchising, grouping of franchise company members, establishment of regulation and certification of franchise business in Serbia. This certainly implies, as a first step, continuing education about franchise business, because we want to present franchise benefits, organize conferences where Serbian businessmen will exchange experiences with others from the region and the EU, as well as numerous consultations that SFA will provide to all those interested in buying or creating a franchise concept. SFA members are renowned companies from Serbia, both domestic and foreign brands, which with their many years of existence prove the principles of successful franchising.

eKapija: How do you see the future of franchising in Serbia?

- In the light of the newly founded Serbian Franchise Association and the support received from the business community, as well as from the SCC, I cannot doubt the progress of this sector, especially when it comes to the affirmation and raising of awareness about franchise business. Already at this moment, SFA is approached by a large number of businessmen with the indication of creating a franchise, and realizing that this model can be an easier way to expand the recognition of their business.

This is an excellent moment in Serbia to initiate the introduction of a national plan or strategy for the development of the franchise sector. Here I am mostly referring to tools and steps that would facilitate the path to franchise business, and which is a much safer way of entering into entrepreneurship. I am primarily referring to non-reimbursable, financial support, which would facilitate the purchase of a franchise, encouraging the creation of franchises by our successful business models, forming a register of franchises - so we could monitor the sector, and certainly education, education and education.
